GE Honeywell v European Commission (Court of First Instance)
On 14th December 2005 the Court of First Instance upheld the Commission's decision to block the merger between GE and Honeywell despite it being cleared by US competition authorities previously. The court did question, however, the Commission's reliance on the "theory of conglomerate effects." That theory predicts the merger would have created a company that could squeeze suppliers and control prices; a theory which came under attack earlier this year in the Tetra Laval and Sidel case.
